By accessing or using Akshit Pareta's website and design subscription services, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions stated herein, you may not access or use our services.
These terms apply to all visitors, clients, and subscribers who access or use our services. We reserve the right to update or modify these terms at any time. Continued use of our services following the posting of changes constitutes your acceptance of those changes.
If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms. If you do not have such authority, you must not accept these terms on behalf of that entity.
Akshit Pareta provides design subscription services that give clients access to dedicated design resources on a monthly basis. Our subscriptions include unlimited design requests, which are processed sequentially according to your prioritized queue. Each request is worked on by our team and delivered within the timeframes outlined in your subscription plan.
Deliverables may include but are not limited to brand identity design, website design, UI/UX design, presentation design, social media graphics, marketing collateral, and illustration work. The specific scope and turnaround times depend on your selected subscription tier.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We will provide reasonable notice of any material changes that affect active subscriptions. Service availability and features may vary based on your subscription plan and geographic location.
Subscriptions are billed on a monthly recurring basis. Payment is due at the start of each billing cycle and is processed automatically through our payment provider. All fees are quoted in US dollars unless otherwise specified, and are exclusive of applicable taxes.
You may pause your subscription at any time through your account dashboard. Paused subscriptions retain your unused design capacity for up to 60 days. You may cancel your subscription at any time, and cancellation takes effect at the end of your current billing period. No prorated refunds are issued for partial months.
We offer a satisfaction guarantee on your first month of service. If you are not satisfied with the quality of our work within the first 14 days, you may request a full refund. After this period, refunds are handled on a case-by-case basis at our discretion. Failed payment attempts may result in suspension of services until the balance is resolved.
Upon full payment for a billing cycle, you receive full ownership of all design deliverables produced during that period. This includes source files, assets, and all associated intellectual property rights. You are free to use, modify, and distribute these deliverables for any lawful purpose.
Akshit Pareta retains the right to showcase completed work in our portfolio, case studies, and marketing materials unless you specifically request otherwise in writing. This portfolio license is non-exclusive and does not affect your ownership of the deliverables.
Any pre-existing intellectual property, including proprietary design systems, templates, frameworks, and methodologies developed by Akshit Pareta prior to or independent of your engagement, remains the property of Akshit Pareta. You receive a perpetual, non-exclusive license to use any such pre-existing materials incorporated into your deliverables.
Either party may terminate the subscription relationship at any time. If you choose to cancel, your subscription remains active until the end of the current billing period, during which time you will continue to receive services and deliverables as normal.
We may terminate or suspend your access to our services immediately, without prior notice, if you breach any provision of these Terms of Service, fail to make timely payments, or engage in conduct that we determine, in our sole discretion, to be harmful to our business or other clients.
Upon termination, we will deliver any completed or in-progress work within five business days. You retain ownership of all fully paid deliverables. Any outstanding invoices become immediately due upon termination. Sections of these terms that by their nature should survive termination will remain in effect.
To the maximum extent permitted by applicable law, Akshit Pareta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of our services.
Our total cumulative liability to you for any and all claims arising from or related to these terms or our services shall not exceed the total amount paid by you to Akshit Pareta during the three months immediately preceding the event giving rise to the claim.
These limitations apply regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, and even if Akshit Pareta has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you in full.
